End User License Agreement (EULA)

This End-User License Agreement ("EULA") is a legal agreement between you and Gamer Guardians LLC ("we," "us," or "our") concerning your use of our licensed application ("Licensed Application"). By using the Licensed Application, you agree to be bound by the terms and conditions of this EULA.

Acknowledgement:

This EULA is concluded between you and Gamer Guardians LLC only, not Apple, and we are solely responsible for the Licensed Application and its content. The EULA must comply with the Apple Media Services Terms and Conditions, which you have had the opportunity to review.

Scope of License:

The license granted to you for the Licensed Application is a non-transferable license to use the Licensed Application on any Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions. This license also permits the Licensed Application to be accessed and used by other accounts associated with you via Family Sharing or volume purchasing.

Maintenance and Support:

Gamer Guardians LLC is solely responsible for providing any maintenance and support services for this Licensed Application, as required by law or as specified in this EULA. Apple has no obligation to provide any maintenance or support services for the Licensed Application.

Warranty:

Gamer Guardians LLC is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the Licensed Application to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price of the Licensed Application to you. To the maximum extent permitted by law, Apple will have no other warranty obligations, and any other claims, damages, or liabilities arising from any warranty failure will be the sole responsibility of Gamer Guardians LLC.

Product Claims:

You acknowledge that Gamer Guardians LLC, not Apple, is responsible for addressing any claims by you or any third party relating to the Licensed Application or your possession and/or use of it, including but not limited to:
(i) product liability claims,
(ii) claims that the Licensed Application fails to comply with applicable legal or regulatory requirements, and
(iii) claims arising under consumer protection, privacy, or similar legislation, including in connection with the Licensed Application’s use of HealthKit or HomeKit.

Intellectual Property Rights:

In the event of any third-party claim that the Licensed Application or your possession and use of it infringes third-party intellectual property rights, Gamer Guardians LLC will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.

Legal Compliance:

By using the Licensed Application, you represent and warrant that:
(i) you are not located in a country that is subject to a U.S. Government embargo or has been designated by the U.S. Government as a “terrorist supporting” country, and
(ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

Third-Party Terms of Agreement:

You must comply with applicable third-party terms of agreement when using the Licensed Application. For example, if the Licensed Application is a VoIP application, you must not be in violation of your wireless data service agreement while using it.

Third-Party Beneficiary:
‍
You and Gamer Guardians LLC acknowledge and agree that Apple, and Apple’s subsidiaries, are third-party beneficiaries of this EULA, and upon your acceptance of the terms and conditions of this EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary.
