‍Gamer Guardians, LLC. (“Gamer Guardians” “we,” “us” or “our”) is committed to respecting the privacy rights and concerns of users of our website or application (the “Service”).  

We are here to help you and your children communicate through gaming, and keep yourself safe, secure, and private in the process. 

We have established and implemented this Privacy Policy to inform users of the Service about how we use and protect the information we collect through the Service.

‍WHAT SECURITY MEASURES ARE IN PLACE?

‍We created Gamer Guardians to help you and your children communicate online with gaming. 

Unlike other online chat systems, we plan on giving you, the parents, more control over what's said, who your children communicate with, and what your children can do while online with others.  We do want to note that even with all the tools we provide you parents, we do allow users to add content to our Service in a lot of different ways, like direct messaging and interactions in large and small digital spaces.  If you share content in a large group, it could be accessed by a lot of people, including strangers. 

Further, depending on privacy controls set forth by parents, it could be accessed by general users instead of friends and family.  Naturally, we trust that you will help your children and that you will use the tools we provide you to help control not only your privacy, but the privacy of your children.  

‍Our Data Security Measures

‍We treat data as private information that must be protected against loss and unauthorized access.  To safeguard the confidentiality and security of your PII, we may use industry standard practices, engage specialized vendors, and technologies including but not limited to firewalls, encrypted transmission and data encryption of sensitive personal information when it is stored to disk.

‍However, no server, computer or communications network or system, or data transmission over the Internet can be guaranteed to be 100% secure. As a result, while we strive to protect user information, we cannot ensure or warrant the security of any information you transmit to us or through the Service and you acknowledge and agree that you provide such information and engage in such transmissions at your own risk. Once we receive a transmission from you, we will endeavor to maintain its security on our systems

‍Protecting Your Child Online

‍Gamer Guardians takes children’s privacy seriously and encourages parents to play an active role in their Children’s online experience at all times.  

We urge parents to instruct their Children never to give out their real names, addresses, or phone numbers, without parental permission, when on-line. While we strive to create a safe space online through moderators and moderation tools, no online community is without potential risks.  You should never, ever, provide information about yourself to someone you do not know online. 

‍Further, remember that just because you share something with someone in a private chat between users, it doesn't mean it will stay private between those users.  We can attempt to take measures to protect your information against unauthorized disclosure from a hack, but cannot exercise full control over the actions of our users, especially if such activity occurs outside of the Service (i.e. posting screenshots or captured footage on TikTok/Instagram/YouTube).  

Furthermore, regarding Children, we will take measures to limit our collection of personal information from Children to no more than is reasonably necessary.  If you have any concerns about your Child’s personal information, please contact us at max@gamerguardians.com, with the subject line "Child Privacy."

‍WHAT IS COLLECTED BY GAMER GUARDIANS AND HOW?

‍We collect information about you in various ways, including through your communications with us, your interactions with our Services, technologies we use on our website, and through third parties, including social media platforms.   Some of these are obvious, like when you provide us your information directly, (i.e. creating an account, making a purchase, communicating with us, or interacting with us on social media).  These will always be obvious, and you'll know what you're providing us because you're the one creating an account, paying for the Service, or using the Service to chat with other users.

‍The purpose of the Service is to assist parents by providing an alternative to other online chat systems, allowing a safe, parent-supervised chat platform for online gaming.  We need the types of information that we describe below in order to process payments from you to use the Service, as well as ensure the safety of our Service.

‍Again, it's typically collected either through you directly (i.e. when you make an account) or indirectly.  If we collect something indirectly, it is through:

‍What do we collect about you?

‍We do collect certain pieces of personally identifiable information, or "PII." PII means information that can be used to identify and contact you.

Additionally when you make a purchase or attempt to make a purchase through the Service, we collect certain information from you, including your name, billing address, shipping address, payment information (including credit card numbers), email address, and phone number. ‍What information is collected about the Children? 

‍Gamer Guardians collects information based on the Child's use of the Service, like device type and settings, log information (i.e. how the service is used, event information and an IP address, as well as unique application numbers, version number, and unique identifiers (like your Childs' username) which is used to collect and store information about an app or device, like preferred language and app activity.  We don’t collect your child's name, address, or phone number.  Regarding any data we collect for a Child, we will retain this information only for as long as reasonably necessary to allow the Child to use the Service, and ensure the security of our users and our services, or as required by law.  In the event that we discover that data has been collected in conflict with the requirements of the U.S. Children's Online Privacy Protection Act, we may either delete the information immediately or seek the parent's consent for that collection. 

‍Children’s Privacy

‍People under 18 years old (a "Child" or "Children") are permitted to use the Service with the creation of an account by their parent or legal guardian over age 18 (a "Parent").  We recognize the need to protect Children with additional privacy and protections with respect to personal information we may collect from Children on our Service.  If a Child wishes to use our Service, we will ask for the Parent's email with a separate login, so the Parent will be informed of the Child's activities, can monitor their Child's activity, and meaningfully participate with the Child's gaming experiences.  As part of this consent, we may ask for the Parent's credit card number, communication with one of our representatives by telephone or a signed consent form by mail, email attachment or fax.  Any individual under age 18 will not be permitted to create an account without parental consent, and information regarding any individual under age 18 will only be collected with the consent of the Parent.

‍We may use your PII and other non-personal information for all legal purposes, including the following: Facilitating and allowing communication between users on the Service. Voice chats may be monitored for quality and safety, but are never recorded or stored by Gamer GuardiansTo collect and process payments by users of the Service to the Company.Providing Technical Support: We use your personal information to provide technical support that you may request in using our Service. Responding to Copyright Disputes: We may also use your PII in response to copyright disputes that you may submit through the DMCA process.   Fine-tuning the Services: We use your comments, feedback and cookie information to better tune the Services to address your needs and desires for information.Creating aggregated statistical data and other aggregated or noninferred non-personal information, which we or our business partners may use to provide and improve our Service.Complying with applicable laws and regulations.

‍First off, we know you're curious, but we do not sell your data to third parties.  We value your privacy and your peace of mind.  We will share the personal information we collect from you under the following circumstances:Protection of rights. For example, we may partner with other companies to process payments for the Service, this is like the Google App Store or Apple App Store. Additionally, we may partner with other companies to process, analyze, and/or store data, including, but not limited to, Analytical Data used to tweak and maximize your experience. While providing services for us, these companies may access your personal information. To the extent applicable, we require these entities to comply with this Privacy Policy and appropriate confidentiality and security measures.

‍When you click on a third party logo or URL displayed on our Service that links you to a different website, our Privacy Policy no longer applies and you must read the privacy policy of the third party to see how your personal information will be handled on their website. We are not responsible for their collection and use of your personal information.

You must provide us with the email address previously submitted to us regarding the Service and the details of your privacy request, including any reasonable verification measures we may request.  Please note that we will never ask you to provide information you haven't already disclosed to us in order to verify your identity.   This can also be done by accessing the website or Service and deactivating your profile.

‍Data Retention

‍Gamer Guardians does not intend or plan to retain any personally identifiable data on any users of the Service.  Gamer Guardians reserves the rights to retain information as necessary to improve the Service and respond to legal requests.  You may have the opportunity to opt-out of certain communications and modify any demographic information you've provided. Please be aware this may take several hours to be reflected. Upon an event requiring deletion of your account data under law, Gamer Guardians deletes all of the above-mentioned data in its possession within a reasonable timeframe. Gamer Guardians does not verify the correctness of personal data. In some cases, we may not be able to delete your personal information, and will retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements. We take reasonable steps and appropriate measures to protect data from loss, misuse, unauthorized access, disclosure, alteration, and destruction.Please note that some data may be retained if necessary to resolve disputes, enforce Gamer Guardians' user agreements, and comply with technical and legal requirements and constraints related to the security, integrity and operation of the Service.

‍If you are a resident of the European Union, we do not know why you are reading this.  Our service does not cater to the EU or its residents, and is not meant to be used in the EU.  It should be noted that the Service provides information mostly pertaining to the United States.  However, as a European Union Resident, you enjoy certain protections under the Global Data Protection Regulation or GDPR. The GDPR is a new piece of legislation applying to users residing within the European Union.

You agree that if the matter remains unresolved for forty-five (45) days after notification (via certified mail or personal delivery) that a dispute exists, all parties shall join in mediation in Walnut Creek, California with a mutually agreed mediator in an attempt to resolve the dispute. Should you file any arbitration claims, or any administrative or legal actions without first having attempted to resolve the matter by mediation, then you agree that you will not be entitled to recover attorneys’ fees, even if you would otherwise be entitled to them.
